OFFICIAL "DESIGN MYSTIC PATHS’ LOGO" CONTEST RULES

1. Description of the Contest: The Mystic Paths Logo Competition (the “Contest”) is designed to encourage eligible patrons to use their creativity to aid in the design of a Mystic Paths logo. Judges will choose the winning entries and prizes will be awarded in accordance with these Official Rules.

2. Sponsor: The Contest is sponsored by Mystic Paths. (“Mystic Paths”), a Visionary Resource supplier, with principal place of business at www.mysticpaths.net. The Sponsor reserves the right to modify or cancel the Contest in the event that any portion of any website used to administer any aspect of the Contest becomes technically corrupted.
3. Binding Agreement: In order to enter the Contest, you must agree to these Official Rules (“Rules”). The Rules consist of the terms and conditions on this page. You will not be eligible for the prizes described in these Rules unless you agree to these Rules. You agree that a submission of an entry in the Contest constitutes your agreement to these Rules. Minors must obtain the prior permission of your parent and/or legal guardian and your parent and/or legal guardian must also agree to these Rules on their and your own behalf before you can enter this Contest because you will be bound by these Rules and these Rules will form a legally binding agreement with respect to this Contest, please read them carefully. Consent forms will be sent upon request.

4. Submissions: The winning entry will become the property of Mystic Paths. Mystic Paths will exclusively own the rights to winning submission. The contest winning Logo cannot be used, reproduced, posted or sold in any form or through any medium without the express written authorization of Mystic Paths.  All rights to the logo and its use become solely owned by Mystic Paths.

5. Right to Use Your Work and Information: (a) Winning Entries become the property of Mystic Paths and will not be acknowledged or returned. By submitting an Entry: (a) you represent and warrant that your Entry is wholly original and does not incorporate or include anything that is owned by any third party and does not violate any copyright, trademark, publicity right, or any other right of any third party; (b) you agree that your Entry shall be a "work made for hire," with all rights therein, including, without limitation, the exclusive copyright, being the property of Mystic Paths; and (c) in the event your Submission is not considered a winning entry/"work made for hire," Mystic Paths will return all right, title, and interest in your Entry. You represent and warrant that (i) YOU OWN AND/OR CONTROL ONE HUNDRED (100%) PERCENT OF ALL RIGHT, TITLE AND INTEREST IN AND TO THE CONTENT AND ALL ELEMENTS CONTAINED THEREIN (II) the Content does not and shall not infringe on any copyright or any other third party right nor violate any applicable law or regulation, (III) you have the right to grant any and all necessary rights and licenses provided herein, including without limitation, all necessary copyright and other related rights to the Content, free and clear of all claims and encumbrances without violating the rights of any person or entity, including any right to privacy or publicity. You hereby hold Mystic Paths harmless from and against any third party claim arising from use of the Content. You waive any right to privacy. You waive any right to inspect or approve uses of the Content or to be compensated for any such uses. You hereby represent and warrant that you that you have read this release and are fully familiar with its contents.
   
   (b) By submitting an Entry, you grant to Mystic Paths and its affiliated companies the right, except where prohibited by law, to use your name, likeness, picture, address (city and state), e-mail address, voice, biographical information, submission/Entry and written or oral statements, for advertising and promotional purposes in promoting or publicizing Mystic Paths and its products or services, without compensation unless required by law. You shall have no right of approval, no claim to compensation, and no claim (including, without limitation, claims based on invasion of privacy, defamation, or right of publicity) arising out of any use, blurring, alteration, or use in composite form of your name, picture, likeness, address (city and state), e-mail address, biographical information, or entry. The rights granted under this paragraph shall extend to Mystic Paths and its affiliated companies with respect to all entrants in the Contest, including those entrants who are selected as winners and those entrants who are not selected as winners. Mystic Paths is under no obligation to use the winning Entries for any purpose.

6. Eligibility: [NO PURCHASE NECESSARY.]   Eligibility is open to anyone to enter the "DESIGN MYSTIC PATHS’ LOGO" (the "Contest"). Contestants under 18 are required to have their parent or guardian's permission to enter as described above and may be required to submit a Consent form.  Non-US residents, agree to waive any laws that may go beyond US laws described herein, and otherwise agree to be bound by the rules contained herein. Internet access is required to register for the Contest. The Entrants must also agree to participate in any Media Activity, as outlined in Paragraph 13 below. This Contest is void where prohibited.

7. Entry: (a) To enter the Contest you must email (i) your name, mailing address, phone number, and age, (ii) the text that states "I have READ and AGREE to the Official Rules of the Design Mystic Paths New Logo Contest", (iii) a high-resolution, print-quality Mystic Paths logo submission as a .jpeg, .gif,  .eps, .ai, or .tif formatted file as further described below (a "Logo") to the following email address: mysticpaths.net@gmail.com. Failure to include the text in (ii) above will qualify your entry returned until text is appropriated. It will not disqualify your entry necessarily, as your submission implies that you have agreed to all of the rules.
   
   Contest begins on June 1, 2009 at 12:00AM, Eastern Time. All entries must be received by July 31, 2009 before 12:00 AM, Eastern Time. Each submission is the entry form must all persons who appear in or have contributed to the production of the Mystic Paths Logo. Only one Entry per person. If multiple entries are received by the same entrant, only the first Entry submitted by that entrant will qualify for entry in the Contest; subsequent entries submitted by that entrant will be returned. Each entry must, however, have at least one (1) valid email account in order to qualify. By entering, entrants agree to be bound by the decisions of the judges and these Official Rules and to comply with all federal, state, and local laws and regulations. Mystic Paths and those working for or on the behalf of will not be responsible for lost, late, misdirected, damaged, or postage due mail or e-mail, or for Internet, computer hardware and software, phone, and other technical errors, malfunctions, and delays. Entries which are mutilated, incomplete, illegible, inaccurate, forged, irregular in any way, or otherwise not in compliance with these Official Rules are also void. In the event of a dispute concerning who submitted an e-mail entry, the Entry will be deemed to have been submitted by the authorized holder of the e-mail account from which the Entry is made. The "authorized account holder" is the natural person to whom an email address is assigned by an Internet access provider, online service provider or other organization (e.g., business, educational institution, etc.) responsible for assigning email addresses for the domain associated with the submitted email address.
   
   (b) Each entry form must be accompanied by the following: Variations of the Logo "Mystic Paths" in accordance with the Guidelines. Such validly and properly submitted Logo accompanied by your name, mailing address, phone number, age, and the text that states "I have READ and AGREE to the Official Rules of the Design Mystic Paths’ New Logo Contest" is hereinafter referred to as an "Entry". Each submission must be wholly original and created entirely by you and must not incorporate or include anything that is owned by any third party or would require the consent of any third party and your submission must not violate any law or the copyright, trademark, publicity right, privacy right or any other right of any third party.
   
   (c) NO PURCHASE NECESSARY.
8. Contest Period: Contest begins on June 1, 2009 at 12:00AM, Eastern Time. All entries must be received by July 31, 2009 before 12:00 AM, Eastern Time.

9. How to Enter: Register on the Mystic Paths website (www.mysticpaths.net) (“Website”) between June 1, 2009 at 12:00AM, Eastern Time. Through July 31, 2009 before 12:00 AM, Eastern Time. Contest instructions on how to participate in the Contest will be on the Website. Contest entries are preferably received electronically to the address indicated on the Website. Submissions must also be complete, be in English (unless otherwise specified), and must be received by Mystic Paths no later than 11:59:59 P.M. Easter Time on July 31, 2009 to be considered eligible entries. Mystic Paths accepts no responsibility for submissions lost, delayed, damaged, defaced, or mislaid, howsoever caused. Each Entrant may make only submission. All intellectual property and industrial property rights in any entries that belonged to the Entrants will remain with the Entrants until selection of Winner, then becomes the property of Mystic Paths, and will not be returned after the Contest.

10. Conduct: By entering the Contest, you agree to comply with and be bound by these Official Rules, which will also be posted on the Website. Failure to comply with these Rules may result in disqualification from the Contest. You further agree to comply with and be bound by the decisions of the judges, which are final and binding in all respects. Mystic Paths reserves the right in its sole discretion to disqualify any Entrant it finds to be: (1) tampering or attempting to tamper with the entry process or the operation of the Contest; (2) violating the Official Rules; (3) violating the terms of service, conditions of use or general rules or guidelines of any Mystic Paths property or service; or (4) acting in an unsportsmanlike or disruptive manner, or with the intent to annoy, abuse, threaten or harass any other person. Any false information provided within the context of the Contest by any Entrant concerning identity, postal address, ownership of right or non-compliance with the Rules may result in the immediate elimination of an Entrant from the Contest. Mystic Paths further reserves the right to disqualify any entry that it believes in its sole and unfettered discretion infringes upon any law or otherwise does not comply with these Rules. CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY PROPERTY OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, MYSTI PATHS RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

11. Judging and Selection of Winners: All entries will be judged by the owner of Mystic Paths based on the following judging criteria: 1) artistic merit, 2) creativity, 3) theme communication, 4) appropriateness of the supporting statement, and 5) whether the submissions adhered to these Rules. Decisions of the judges are final and binding. If any winner is not able for whatever reason to accept their prize, then Mystic Paths reserves the right to award the prize to another Entrant. Submissions may be subject to public poll. Winners will not be chosen by public vote; however, results will be considered. Subject to receipt of a sufficient number of qualified Entries, there will be one (1) winner of the Contest. Winner will be selected on or about August 31, 2009. Odds of winning depend on the number of eligible Entries received. The decision of the judges shall be final and binding in all regards. Winner will be notified by telephone or email, and may be required to sign and return an Affidavit of Eligibility and Publicity/Liability Release (and any other documents required by Mystic Paths), within ten (10) days of notification. The Affidavit of Eligibility must be complete and must include each winner’s social security or resident alien identification number. The information in winner’s Affidavit of Eligibility must be correct and must be identical to the information provided in winner's Entry or the winner will be disqualified. If a winner cannot be contacted, is ineligible, fails to claim a prize, fails to return the completed and executed documents required above, if a prize is returned as undeliverable or if a winner fails to comply with any of the provisions of these rules, such winner's prize will be forfeited. If a prize is unclaimed or forfeited it will not be awarded.

12. Prizes: (a) The Winner will receive a free product basket with Mystic Paths choice of products, a gift voucher of $30.00, and our eternal appreciation!! Products and services can be viewed on Website. The winner can apply gift voucher to products or services at any time. There is not an expiration date on gift voucher. Shipping is included. Winner is responsible for providing shipping address and any other incidentals or expenses. There is no cash alternative and the prizes must be taken as offered. Gift voucher can be redeemed upon creation of a Customer Account. Mystic Paths reserves the right to substitute prize(s) of an equivalent value should the prizes become unavailable for any reason. Taxes, fees and all other charges, if any, are the sole responsibility of winner. By accepting the prize, winner releases and discharges Mystic Paths, affiliated companies and their respective parents, subsidiaries, affiliates, advertising and promotion agencies, and all their respective employees, officers, directors, representatives and agents from any liability or damage due in whole or in part to the award, acceptance, possession, use or misuse of any prize or from participation in this Contest. Prizes are not redeemable for cash or substitutable for any other item by winners.  (b) If, for reasons beyond the Mystic Paths’ control (including, but not limited to, tampering or computer virus infection or litigation with Mystic Paths), the Contest is not capable of running as originally planned, Mystic Paths, at its sole discretion, reserves the right to cancel or modify the Contest, without liability. All taxes (including, but not limited to, income taxes) are the sole responsibility of winners. Prize winners (and parent(s) or guardian(s) of prize winners under 18) may be required to execute (and have notarized) an Affidavit of Eligibility, a Liability Release, and/or a Publicity Release (the "Affidavit/Release") which must be returned to and received by Sponsor within ten (10) days from winner’s receipt of the Affidavit/Release. Winners may also be required to send a copy of their passport, driver’s license, or birth certificate as proof of age and residency. Non-compliance with any of these requirements may result in disqualification, in which case an alternate winner may be chosen. Return of prize, prize notification, Affidavit/Release as undeliverable will result in disqualification and an alternate winner may be selected. All entrants agree to comply fully with each provision in these Official Rules. Any person attempting to defraud or in any way tamper with this Contest and any person who does not comply with these Official Rules, will be ineligible for any prize(s) and may be prosecuted to the full extent of the law.

13. Media Activity: By participating in this Contest, you agree and hereby grant Mystic Paths permission to use, copy, modify and make available your submissions to the public (with or without attribution to you) for any purpose, such as, but not limited to, press and media communications, without further compensation to you. You also agree to participate in any media or promotional activity regarding the Contest. If you are a winner, you agree that Mystic Paths may use your name and likeness to administer and promote the Contest and to conduct media interviews and promotional events.

14. Privacy Notice: By participating in this Contest, you agree that we can collect your personal information, and that if we cannot collect the required data, you may not be eligible to participate in the Contest. Any personal information collected during the course of the competition by Mystic Paths will only be used for administering this Contest and for other purposes as outlined in these Rules, and will be subject to the practices described in the Mystic Paths Privacy Policy (http://www.mysticpaths.net/pages.php/page/privacy ). By submitting an Entry, you hereby agree to be notified of the winner via email, and to receive further email updates regarding Mystic Paths. However, you may unsubscribe at any time by emailing us with “Unsubscribe” in the Subject heading. You will have the right to access, review, rectify or cancel any personal data held by Mystic Paths by writing to Mystic Paths (Attention: Privacy Matters) at the Mystic Paths email address listed on the Website.

15. General Conditions: This Contest is governed by the laws of the State of Indiana, United States. All federal, state and local laws and regulations apply. By participating in this Contest, you agree to be bound by the terms of these Official Rules and by Mystic Paths’ decisions, which are final and binding on all matters pertaining to this Contest. Return of any prize/prize notification may result in disqualification and selection of an alternate winner. Any potential winner who cannot be contacted within fifteen (15) days of attempted first notification will forfeit his or her prize. Potential prize winners may be required to sign, notarize and return an Affidavit or Declaration of Eligibility, a Liability/Publicity Release, an I.R.S. Form W-9, and provide any additional information that may be required by Mystic Paths. Failure to comply within this time period may result in disqualification and selection of an alternate winner. Mystic Paths is not responsible for any typographical or other error in the printing of the offer, administration of the Contest or in the announcement of the prizes. Entrants certify that their entry is original and that they are the sole and exclusive owner and rights holder of the submitted entry (or if they are not sole and exclusive owner and rights holder of the submitted entry, that they have obtained the necessary permission to include the entry in the Contest) and that they have the right to submit the entry in the Contest. Each entrant agrees not to participate in the Contest in any manner that might (1) infringe any third-party proprietary, intellectual property, industrial property, personal rights or other rights, including without limitation, copyright, trademark, patent, trade secret or confidentiality obligation; or (2) otherwise violate applicable law in any countries in the world.

16. No Recourse to Judicial or Other Procedures: To the extent permitted by law, the rights to litigate, to seek injunctive relief or to any other recourse to judicial or any other procedure in case of disputes or claims resulting from or in connection with this Contest are hereby excluded, and you expressly waive any and all such rights.

17. LIMITATIONS OF LIABILITY: TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU INDEMNIFY AND AGREE TO KEEP INDEMNIFIED MYSTIC PATHS AT ALL TIMES FROM AND AGAINST ANY LIABILITY, CLAIMS, DEMANDS, LOSSES, DAMAGES, COSTS AND EXPENSES RESULTING FROM ANY ACT, DEFAULT OR OMISSION BY YOU AND/OR A BREACH OF ANY WARRANTY BY YOU SET FORTH HEREIN. TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU INDEMNIFY AND AGREE TO KEEP INDEMNIFIED MYSTIC PATHS AT ALL TIMES FROM AND AGAINST ANY LIABILITY, ACTIONS, CLAIMS, DEMANDS, LOSSES, DAMAGES, COSTS AND EXPENSES FOR OR IN RESPECT OF WHICH MYSTIC PATHS WILL OR MAY BECOME LIABLE BY REASON OF OR RELATED OR INCIDENTAL TO ANY ACT, DEFAULT OR OMISSION BY YOU UNDER THESE RULES INCLUDING WITHOUT LIMITATION RESULTING FROM OR IN RELATION TO ANY BREACH, NON-OBSERVANCE, ACT OR OMISSION WHETHER NEGLIGENT OR OTHERWISE, PURSUANT TO THESE RULES BY YOU. TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AGREE TO HOLD MYSTIC PATHS, ITS RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES AND ASSIGNS HARMLESS FOR ANY INJURY OR DAMAGE CAUSED OR CLAIMED TO BE CAUSED BY PARTICIPATION IN THE CONTEST AND/OR USE OR ACCEPTANCE OF ANY PRIZE WON.

18. Third Parties: Mystic Paths is not responsible for the policies, actions, or inactions of others that might prevent you from entering, participating, and/or claiming a prize in this Contest.

19. Internet: Mystic Paths is not responsible for electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission. Mystic Paths is not responsible for theft or destruction or unauthorized access to or alterations of Contest materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions or limitations of any kind. Mystic Paths is not responsible for inaccurate transmissions of or failure to display Contest materials on account of technical problems or traffic congestion on the Internet or at any website or any combination thereof. If for any reason the Internet portion of the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, Mystic Paths reserves the right at its sole discretion to cancel, terminate, modify or suspend the Contest.

20. Severability: If any provision(s) of these Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.

21. Winner List: The name of the winner will be posted on the Website by August 31, 2009.

22. Miscellaneous: Mystic Paths reserves the right to select the winner, and incorporate various aspects of different designs submitted into the logo we select. If only portions of your design are incorporated, then it will be entirely up to us, in our sole discretion, to determine whether your efforts are entitled to any recognition or compensation. By submitting an Entry, you hereby agree to be notified of the winner via email, and to receive further email updates regarding Mystic Paths. However, you may unsubscribe at any time by emailing us with Unsubscribe in the Subject heading.

23. How to Get More Information: (a) To obtain a list of prize winner, Winners’ names will be posted on the http://www.mysticpaths.net website as well as social networking websites. (b) Questions regarding the Contest can be directed by email to "Design Mystic Paths Logo Contest", mysticpaths.net@gmail.com (c) Copies of these Official Rules and Parental Consent form may be obtained by request at the email listed above. All times and dates in these Official Rules are Eastern Standard Time.
